What you’re agreeing to

By creating an account or making a purchase on Delivered Cards, you agree to these terms. We’ve tried to keep them straightforward. If anything is unclear, feel free to email us at support@deliveredcards.com.

What we do

Delivered Cards is a birthday card mailing service. You tell us who to send a card to, choose a card design, write a message, and we print it and mail it through USPS before their birthday each year. Your subscription covers one friend per year, and you can manage multiple friends with multiple subscriptions.

Subscriptions and pricing

Each subscription costs $5.00 per year and covers one birthday card to one friend. Your subscription renews automatically each year on the anniversary of your purchase. You can cancel at any time from your My Account page, and your subscription will remain active until the end of the current billing period. We do not offer partial refunds for unused time.

We reserve the right to change our pricing. If we do, we’ll notify you by email before your next renewal so you can decide whether to continue.

Your account

You need an account to use our service. You’re responsible for keeping your login information secure. If you think someone has accessed your account without permission, please contact us immediately at support@deliveredcards.com.

Recipient consent and your responsibilities

By using our service, you represent and agree that:

  • You have a legitimate personal or professional relationship with each recipient and have their consent to send mail to their address
  • You will provide accurate mailing addresses (we cannot redeliver cards sent to incorrect addresses)
  • You will not use the service to send cards to anyone who has asked you not to contact them
  • You will not use the service to send threatening, harassing, abusive, obscene, defamatory, or otherwise inappropriate content in card messages
  • You will not use the service to stalk, intimidate, or harass any person
  • You accept full responsibility for the content of all messages you submit and for ensuring that you have the right to send mail to each recipient’s address

We reserve the right to review card messages and refuse to print or mail any content we consider inappropriate, threatening, or abusive. We may suspend or terminate your account without refund if we determine that you are using the service in violation of these terms or in a manner that could expose Delivered Cards to legal liability.

Card content and message liability

You are solely responsible for the content of the personal messages you write in your cards. Delivered Cards acts only as a printing and mailing service and does not author, endorse, or approve the messages submitted by users. We are not responsible or liable for any claims, damages, or disputes arising from the content of your card messages, including but not limited to claims of harassment, defamation, emotional distress, or invasion of privacy.

By submitting a message, you agree to indemnify and hold harmless Delivered Cards, its owners, employees, and agents from any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from or related to the content of your messages or your use of the service. This indemnification obligation survives termination of your account.

Card delivery

We do our best to mail each card so it arrives on or before your friend’s birthday. We typically mail cards 5–7 business days in advance. However, we cannot guarantee a specific delivery date because delivery is handled by USPS and is outside our control.

The return address on every card is the billing address on your account. If a card is undeliverable, USPS will return it to you. If you receive a returned card, you can update the address in your My Account page and we’ll use the corrected address for the next year.

What we’re not responsible for

We do our best, but there are a few things we can’t be held liable for:

  • Cards lost, delayed, or damaged by USPS after we mail them
  • Cards sent to an incorrect address that you provided
  • Missed birthdays due to technical issues beyond our control
  • The recipient’s reaction to the card or your message
  • Any consequences arising from the content of the messages you submit
  • Any disputes between you and the recipient of a card
  • Cards sent to recipients who did not wish to receive mail from you

Our total liability for any claim related to the service is limited to the amount you’ve paid us in the 12 months prior to the claim. In no event shall Delivered Cards be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action.

Prohibited uses

You may not use Delivered Cards to:

  • Send unsolicited mail to people you do not know or do not have a relationship with
  • Harass, threaten, stalk, or intimidate any person
  • Send cards containing content that violates any applicable law or regulation
  • Impersonate another person or misrepresent your identity as the sender
  • Send cards for commercial solicitation, advertising, or promotional purposes
  • Violate any applicable federal, state, or local law, including postal regulations

If we become aware of any prohibited use, we may immediately suspend or terminate your account without notice and without refund. We may also cooperate with law enforcement if we believe illegal activity has occurred.

Cancellation

You can cancel your subscription at any time from the My Account section of our website. When you cancel, your subscription stays active through the end of your current billing period, and no further charges will be made. Your friend’s information will be retained in case you decide to resubscribe, but you can also request we delete it by contacting us.

Refund policy

Because our service involves printing and mailing a physical product, we generally do not offer refunds once a card has been printed or mailed. If we made an error (wrong card design, wrong address on our end, or failed to mail a card), please contact us and we’ll make it right, either with a replacement card or a refund.

Intellectual property

The card designs, website content, and branding on Delivered Cards are our property. You’re welcome to choose any card for your friends, but you may not reproduce, redistribute, or resell our card designs.

Dispute resolution

If you have a dispute with Delivered Cards, you agree to first attempt to resolve it informally by contacting us at support@deliveredcards.com. If we are unable to resolve the dispute informally within 30 days, either party may pursue resolution through the courts as described below. You agree that any dispute arising from these terms or your use of the service will be resolved on an individual basis and not as part of any class, collective, or representative action.

Disclaimer of warranties

The service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or that any card will be delivered by a specific date. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Changes to these terms

We may update these terms from time to time. If we make significant changes, we’ll notify you by email. Continuing to use the service after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, United States. Any disputes will be resolved in the courts of Virginia.
